Real Estate
We provide clients with legal advice relating to the financing, construction, development, ownership, management, and operation of real estate, resort and hotel-related assets. We represent institutional lenders, developers, owners and investors in connection with their real estate-related activities.
We have advised project owners and developers on preparation and negotiation of documentation related to transfer of land and houses, preparation and negotiation of documentation related to land rental and land acquisition, preparation and negotiation of documentation related to lease of premises, and obtaining permits and clearances from relevant government agencies, including notarization and registration. YKVN is currently advising a Vietnamese state-owned real estate company in connection with the development of a large commercial and office building in Ho Chi Minh City. Our other recent and current representations include the representations of:

the owner of Park Hyatt Saigon Hotel on renegotiation of a management agreement with Hyatt International;

a foreign fund on its acquisition of a 15% equity interest in the company developing the Nam Hai Resort near Danang;

a Vietnamese real estate company on its financing and leasing arrangements with Casino, a French supermarket group -- this will be one of the largest commercial complexes located in the central district of Ho Chi Minh City; and

a subsidiary of CIENCO 5, a Vietnamese State-owned company, on the construction and development of an apartment building and villas in the South of Ho Chi Minh City.

YKVN is very active in real estate and infrastructure financings and the clients greatly benefit from our banking and project finance experience in real estate and infrastructure financings. For example, we are advising Bank for Foreign Trade of Vietnam on a US $6.7 million financing of the construction of Nam Hai Resort near Danang. YKVN recently advised a syndicate of Vietnamese banks led by the Military Bank on financing of the construction of Vincom Tower, the biggest office building and department store complex in Hanoi. YKVN also recently advised a syndicate of banks led by Chinfon Bank, Ho Chi Minh City Branch on a US$ 33 million financing of the Nguyen Van Linh Road in Saigon South project, Phase 3 of Phu My Hung project company.
