International Trade and Tax
YKVN is the only Vietnamese law firm with a strong international trade and tax practice. YKVN regularly works with the international trade practice group of White & Case in Singapore to update international manufacturers, exporters and importers on latest trade regulations and import-export tariffs of Vietnam. We also provide advice on Vietnamese law in regard of customs, export control, anti-dumping, countervailing duty and other trade-related issues. Our advice also relates to Vietnamese regulations implementing regional cooperation treaties, i.e., the Common Effective Preferential Tariff (CEPT) and ASEAN Industrial Cooperation (AICO) scheme. Among the clients we have advised on trade issues are Procter & Gamble Vietnam, Matsushita Electric Corporation, JISEA (Japan), APB (Singapore), Toshiba (Japan) and Toyota Motor Management Services (s) Pte Ltd (Singapore).
As noted above, YKVN and White & Case are advising Vietnam Association of Seafood Exporters & Producers (VASEP) and its members in connection with a U.S. anti-dumping proceeding aimed at imposing antidumping duties on imports of fish fillets from Vietnam. The two firms are also advising VASEP and its members with respect to recent EU directives requiring inspection of Vietnamese shrimp exports.
YKVN and White & Case are assisting the Ministry of Industry to review and outline the action plan for the implementation of the Automotive Master Plan. This review is to comment on and provide the Ministry of Industry with practical suggestions for the implementation of its Automotive Master Plan, taking into consideration of Vietnam's present and future trade obligations under its bilateral, regional and international trade agreements.
YKVN recently advised a major Japanese trading company on the tax implications for its proposed participation in upgrading a television broadcasting center. The project is funded by ODA concessionary loans of approximately ¥ 20 billion. We recently assisted White & Case in advising a major Japanese car manufacturer on the tax implications of its regional service operations in Japan, Malaysia, Thailand and Vietnam under double tax avoidance treaties of Vietnam. We also worked with White & Case to advise a wholly-owned subsidiary in Vietnam of an international insurance company on the taxability of its proposed purchase of Vietnam Brady Bonds.
